These Terms of Service ("Terms") govern your use of the FlightKlub platform (the "Service") and any charter bookings facilitated through it. By submitting a booking request or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.
1. About FlightKlub
FlightKlub is a private aviation concierge platform operated by FlightKlub Aviation Services (India). FlightKlub is not an air carrier, airline, or non-scheduled air transport operator (NSOP). We act as an intermediary that sources, quotes, and arranges charter flights on your behalf with DGCA-licensed operators. The air carrier identified in your booking confirmation is solely responsible for the operation of your flight.
2. Booking Process
All bookings on FlightKlub follow a concierge request model:
- You submit a flight request (route, date, passenger count, preferences).
- FlightKlub sources availability from licensed operators and sends you a quote within 2 hours.
- You confirm the quote and pay a deposit to hold the aircraft.
- FlightKlub confirms the booking with the operator and sends you a booking confirmation.
- Balance payment is due as specified in your quote. Tickets and flight details are released on receipt of full payment.
A booking is confirmed only upon FlightKlub issuing a written booking confirmation. Quotes, estimates, and WhatsApp messages do not constitute a confirmed booking.
3. Pricing and Payment
- All prices are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
- Prices are valid only for the duration specified in the quote. Aircraft availability and fuel surcharges can change rapidly.
- A minimum deposit of 25% of the total charter cost is required to confirm a booking. The deposit amount will be stated in your quote.
- Balance payment is typically due 72 hours before departure, unless otherwise specified in your confirmation.
- Payments are processed via Razorpay. FlightKlub does not store card or bank details.
- Additional charges may apply for: extended ground time, de-icing, international handling, catering upgrades, additional legs added after confirmation, or landing fees not included in the original quote.
4. Cancellation and Refund Policy
Cancellations must be communicated in writing (email or WhatsApp) to FlightKlub. Refunds are subject to the following schedule:
| Notice given before departure | Refund on deposit | Refund on full payment |
|---|---|---|
| More than 14 days | 75% | 90% |
| 7–14 days | 50% | 70% |
| 3–7 days | 25% | 50% |
| Less than 72 hours | 0% | 25% |
| No-show / departure missed | 0% | 0% |
FlightKlub's service fee (typically 5–10% of the charter cost) is non-refundable in all cases. Refunds are processed within 10–15 business days to the original payment method.
5. Aircraft Substitution
FlightKlub and the operating carrier reserve the right to substitute the confirmed aircraft with an equivalent or superior aircraft in the event of technical issues, unserviceability, or regulatory requirements. You will be notified of any substitution as soon as possible. If a substantially inferior aircraft is the only available option and you do not accept it, you are entitled to a full refund.
6. Flight Delays, Diversions, and Cancellations by the Operator
Flights may be delayed or cancelled by the operating carrier due to weather, air traffic control restrictions, technical unserviceability, or regulatory reasons. In such cases, FlightKlub will make best efforts to source an alternative aircraft. If no suitable alternative is available, a full refund will be issued for the unused portion of the charter. FlightKlub is not liable for consequential losses including hotels, ground transport, missed connections, or business losses arising from flight delays or cancellations.
7. Force Majeure
Neither FlightKlub nor the operating carrier shall be liable for any failure or delay in performance caused by circumstances beyond reasonable control including acts of God, natural disasters, war, terrorism, pandemics, government orders, airspace closures, or airport shutdowns. In force majeure situations, FlightKlub will issue a credit note or refund at its discretion.
8. Passenger Obligations
All passengers must:
- Carry valid government-issued photo identification. International flights require a valid passport and all applicable visas.
- Arrive at the private FBO/terminal at least 30 minutes before the scheduled departure (45 minutes for international flights).
- Comply with all instructions from the aircraft commander, crew, and ground handling staff.
- Not carry prohibited items as defined under DGCA regulations and applicable law.
- Disclose any special requirements (medical, mobility, dietary, animals) at the time of booking.
The aircraft commander has absolute authority over the flight and may refuse to carry or may disembark any passenger who appears unfit to fly, is intoxicated, is disruptive, or poses a safety risk. No refund will be given in such circumstances.
9. Baggage
Baggage allowances vary by aircraft type and are specified in your booking confirmation. As a guide:
- Light Jets: 15–20 kg per passenger (soft bags strongly recommended)
- Midsize / Super Midsize Jets: 20–25 kg per passenger
- Heavy Jets / Ultra Long Range: 25–30 kg per passenger
- Helicopters & Turboprops: 10–15 kg per passenger (soft bags only)
Hard-shell suitcases may not fit in certain aircraft. FlightKlub strongly recommends soft duffel-style luggage. Oversized or overweight baggage may be refused or result in additional charges.
10. Dangerous Goods and Prohibited Items
The carriage of dangerous goods (as defined under ICAO Technical Instructions and DGCA regulations) is strictly prohibited. This includes but is not limited to: explosives, compressed gases, flammable liquids, firearms without prior written clearance, and narcotics. Violation of this provision may result in immediate termination of the booking, no refund, and referral to relevant authorities.
11. Limitation of Liability
FlightKlub's total liability to you in connection with any booking or use of the Service shall not exceed the amount you paid to FlightKlub for the specific booking giving rise to the claim. FlightKlub shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of business, or loss of data.
Liability for personal injury or death arising from the flight is governed by the Carriage by Air Act, 1972 (India) and the applicable convention (Montreal or Warsaw) as incorporated into Indian law. FlightKlub, as intermediary, is not the carrier and is not a party to the contract of carriage.
12. Daily Booking Limit
FlightKlub operates a concierge model and limits new booking requests to 50 per day to maintain service quality. Submission of a request does not guarantee acceptance. FlightKlub reserves the right to decline or defer requests at its discretion.
13. Intellectual Property
All content on the FlightKlub platform including text, graphics, logos, and software is the property of FlightKlub or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
14. User Accounts and Data
If you create an account or submit personal information through the Service, you consent to FlightKlub processing that data for the purposes of fulfilling your booking, communicating with you, and improving the Service. FlightKlub does not sell your personal data to third parties. Data is shared with operating carriers and ground handlers only to the extent necessary to complete your booking.
15. Modifications to Terms
FlightKlub may update these Terms at any time. The current version will always be published at www.flightklub.com/terms. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be notified via email or WhatsApp where practicable.
16. Governing Law and Disputes
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. FlightKlub encourages resolution of disputes through good-faith negotiation before initiating formal proceedings.
